Sa Re Ga Ma Pa 2023 Live In India T&Cs

TERMS AND CONDITIONS

1. “Sa Re Ga Ma Pa 2023 Live in India 2023” (“Contest”) is organized and conducted by Asia TV Limited (“ATL”).
2. By means of these terms and conditions set forth herein (“Terms and Conditions”), ATL is providing an opportunity to interested Participant/Participants (“Participant(s)”) to submit his/her answer to the question (“Entry” or “Entries”) in the Contest on terms more particularly described herein below, which Participant agrees to be unconditionally bound by:
   1. This Contest is organized by ATL to be aired/promoted on its channels i.e., ZEE TV HD (“Channels”) and shall be conducted from 30^th September, 2023 8 PM until 29^th October 2023 10 PM (“Duration of the Contest”) wherein the Participants will have to scan the QR code and answer 1 (one) question pertaining to the Contest. However, ATL has the right to determine any changes in the Contest and/or Duration of the Contest and/or Term in a manner it deems fit.

Term shall commence from the start of the Contest until the Prizes are distributed to the Winners

3. The Contest will be aired/promoted on Channels by ATL in its sole discretion.
4. This Contest is open only to citizens who are Indian residents of United Kingdom at the time of conducting this Contest and above the age of 18 years.
5. The Participant undertakes, warrants, and guarantees that he/she has full legal capacity to participate in the Contest in accordance with law and also these Terms and Conditions. Also, Participant(s) must submit the Entries on their own behalf and Entry (ies) by proxy will not be accepted, even for their family members.
6. The Participant agrees to provide complete and correct information with respect to his/her name, phone number, e-mail address, age and all such other information as may be required by ATL from time to time. ATL has the right at any time to ask the Participant to provide proof of identity and/or eligibility. If the Participant fails to provide such proof immediately upon request by ATL, ATL shall have the right to disqualify the Participant from the Contest and/or withdraw the Contest Prize or end the contest (defined below) at the sole discretion of ATL.
7. The Participant agrees and acknowledges that the Participant is not an employee of ATL, whether directly or indirectly and the Participant’s immediate family members (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren) are not employees of ATL.
8. ATL reserves the unilateral right to withdraw the Sa Re Ga Ma Pa 2023 Live In India contest at any time, without providing any explanation. In the event of withdrawal, ATL shall not be liable for any associated claims or losses.

 

PROCEDURE TO PARTICIPATE IN THE CONTEST AND SELECTION OF WINNER

Participant can participate in this Contest in the following manner:

 

• STEP 1: The Contest question will be aired/promoted during the Duration of the Contest on the Channel.
• STEP 2: Participants who desire to participate in the Contest must submit their Entry via the QR Code (which will direct the Participant to a Zee TV UK website form) which will be on the screen during the Duration of the Contest.
• STEP 3: ATL will select total of 1 (One) Winner (defined below) amongst the correct Entry and shall email the Winner
• STEP 4: Each Winner will get two (2) flight tickets to attend and watch the Tilda Sa Re Ga Ma Pa Finale in India on the 24^th November 2023 (“Live Event”) or such other prize as determined by ATL in its sole discretion. (“Prize”).

10. From all the Participants, those who have answered correctly will qualify to enter the Contest and the winner will be chosen by random selection by ATL (“Winner”). The decision of ATL in connection with the selection process of the Winner will be final and binding and shall not be disputed or challenged by the Participant. In case of any dispute, the decision of ATL shall be final and binding on all concerned. Failure to announce such Winner shall not be considered as a breach on behalf of ATL in any manner whatsoever.
11. The Winners of the Contest will be required to collect their Prize from the Asia TV Limited Office located 128 Wigmore St, London W1U 3SB, UK and produce the email confirmation from ATL announcing the Winner and providing a government identification.
12. Notwithstanding the foregoing, in the event any Participant submits multiple Entries, then the first entry of the Participant shall be deemed to be the Entry of the Participant and all other Entries shall be considered as null and void, as determined by ATL.

 

13. ATL either by itself or through its authorized third-party personnel shall make only one (1) attempt to get in touch with the Winner via contactzeeuk@zee.uk basis the contact details provided at the time of registration. In case ATL is unable to reach the Winner and/or the contact details are incorrect, then such Winner(s) shall deem to have forfeited his/her right to the Prize and ATL may in its sole discretion hand over the Prize to another winner and the same shall be final and binding. ATL shall not be responsible or liable for any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which ATL is unable to intimate the Winner. ATL shall not entertain any questions, correspondence, and inquiries on the manner of conduct of the Winner/Prize from any person whatsoever. Further, if the telephone number of any Participant has been transferred to another individual after Entry into the Contest, the Participant who owned the telephone number at the time of Entry into the Contest shall not claim the Prize or make any claims in respect of the Contest in this regard. Further, the person who owns the number at such time of winning the Contest shall not be entitled to claim the Prize or have any other claims in respect of the Contest.
14. ATL accepts no responsibility under any circumstance whatsoever for including but not limited to incomplete or incomprehensible questions, for technical and/or telephone networks, which become lost, misdirected or delayed.
15. The Contest will run for the Duration of the Contest as mentioned hereinabove or such other timelines as determined by ATL and only the Entries sent during the aforesaid timeframe will be considered valid. Entries received after the timeframe mentioned above will be considered invalid, null and void. ATL shall have the absolute discretion to modify the time when the Contest would be run for. The Participant shall be solely responsible for reviewing these Terms And Conditions periodically for any updates.
16. In the event that any of the Winner(s) selected by ATL is unwilling or unable to give his/her acceptance in a format required by ATL to the Terms and Conditions of the Contest, ATL may select another Winner who gives his/her acceptance to the Terms and Conditions of the Contest. The Winners of the Prize will be announced only after the Winners give their acceptance to compliance of the Terms and Conditions of this Contest. By participating and by submitting the Entries consisting of Participant contact or other details, the Participant hereby grant ATL and all the sponsor(s) of Contest to use, process, retain and monetize the Entries for any purposes including commercial and marketing purposes. The Participant acknowledges that by submitting their Entries, the Participant are expressly granting ATL all required and necessary rights to use any and all information provided as a part of the Entries, in any manner as required by ATL, including sharing all the information provided with third parties in compliance with applicable laws.
17. ATL shall communicate to the Winners the mode and manner of delivery of the Prize. The Prize would be handed over to the Winners only at the agreed place as communicated by ATL and after proper identification, verification and also after the Winner providing proof of payment of all applicable taxes and levies (if applicable). The final decision of the mode and manner of delivery of the Prize shall be that of ATL and shall not be disputed by the Participant failing which ATL shall have the right to choose any other Winner as it deems fit.
18. Upon being declared a Winner, the Winner(s) shall convey their acceptance within 24 (twenty-four) hours from intimation of the same along with providing the following:

• Furnishing his/her name, address, age, sex, contact number;
• A copy of his/her Photo identity card;
• Any valid Proof of address
• In the event the Winner(s) does not confirm or fails to provide the above required document, the Prize shall unconditionally and irrevocably lapse and such Winner will cease to have any right, interest or claim in the same.

19. In addition to the above, in case ATL requires any additional documents/ information, for confirmation, ATL shall convey the same to the Winner and the Winner will be required to comply with requirements of ATL within the time stipulated by ATL. In case of non-compliance in submission of such documents/ additional documents/ information, ATL may decide against giving the Prize to the Winner and the Winner shall have no objection to the same.
20. The Winners will be solely liable to pay any and all taxes, levies, charges, etc. that may be applicable in respect of winning the said Prize. ATL shall not be liable in any manner whatsoever in the event of non-payment by the Winner of any such applicable taxes, levies, charges, etc. Any expenses incurred by ATL in respect of such unpaid tax will be solely to the cost and expense of the Winner. ATL will not bear any additional expenses in relation to the Prize.
21. The Prize shall not be transferable. The Prize shall not be redeemable for kind and/or cash. No request shall be entertained by ATL in this regard. ATL disclaims any liability arising from the Prize.
22. The Participant expressly agrees that ATL will have the unfettered right to reproduce all the Entries on any and all formats, media and/or mediums including but not limited to television, internet, mobile, print, etc.

 

1. TERMS AND CONDITIONS GOVERNING OWNERSHIP OF RIGHTS
2. Participants hereby agree that there is no monetary or any other form of gratification offered by ATL for participation. Participants understand that they may not be chosen or may be eliminated and undertake not to take any action against ATL for such non-selection/ elimination. In the event, that any of the Participant is unwilling to adhere to these Terms and Conditions, such Participant shall be immediately disqualified.

 

24. ATL shall own all rights, title, interest in the Entries, and any and all parts thereof, for the purpose of using, processing, retaining and monetizing in any manner whatsoever whether by ATL and/or its associates/representatives/sponsors/assignees/affiliates etc. including without limitation for publicity or on any platform/channel etc. as deemed fit by ATL. The Participant shall be solely responsible to ensure that the Entries are rights cleared and shall be liable for any claims, etc., which may arise on account of the Entries. The Participant agrees and undertakes that they shall not take any action against ATL and/or its associates/representatives/sponsors/assignees/affiliates etc. for retention and/or use of such Entries in any manner. The Participant(s) hereby agree and irrevocably acknowledge that ATL shall have the sole and exclusive right including but not limited to intellectual property rights (copyrights and trademarks) and other proprietary rights in and to the Contest during and after the Term. The Participant agrees that ATL shall be under no obligation whatsoever to exploit/use any of the materials contained in the Entries, and the Participant’s participation. In the event that ATL does not exploit/use any such materials for a period of 1 (one) year from date of assignment/submission of works, the Participant hereby confirms that the rights will continue to vest with ATL and shall not raise any claim or contest the same.

 

25. The Participant also consents to ATL’s right to use Participant(s) name, voice ,picture or any other attributes provided to ATL without any further permission or compensation for such use in any and all media now known or in commercial use or developed in future based on media now known or in commercial use. The Participant grants ATL irrevocable consent in perpetuity to the use of the sound recordings, photographs, video tape, and illustrations provided or taken by ATL during or in connection with the Entry, in any and all applications including but not limited to advertising, commercials, promotion, stories, text, articles, illustrations, copy and commercial exploitation, in any and all media forms, including but not limited to radio, broadcast and television, newspapers and magazines at any time without requiring the Participant’s further knowledge or consent. The Participant/Winners hereby further undertake to do any and all acts and execute any and all documents in such manner and at such locations as may be required by ATL in its sole discretion in order to secure, protect, perfect or enforce any of the rights of ATL pursuant to this Contest and/or Terms and Conditions. In the event the Participant/Winners fail to do so within two (2) days of receipt of a request from ATL to do or perform an act or execute a document, ATL shall be entitled to exercise the same in place of the Participant as the lawful appointed attorney and the Participant undertakes to affirm, ratify and be bound by such exercise of the right by ATL as mentioned hereunder.

 

26. Under no circumstance shall ATL and/or their directors, employees, officers, affiliates or subsidiaries, be liable to any Participant and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if ATL has been advised of the possibility of such damages. Each Participant agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in England and Wales against ATL and/or their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Contest /participation.

 

27. The Participants acknowledge that by submitting their Entries, the Participants are expressly granting ATL all required and necessary rights to use any and all information and attributes provided as a part of the Entries, in any manner as required by ATL, including sharing all the information provided with third parties. The Participant confirms the accuracy of all information provided by the Participant and shall be absolutely and completely liable for any inaccuracy and claims/expenses arising thereof. ATL reserves the right to disqualify any Entry(ies) immediately if any Participant(s) has supplied untruthful, inaccurate or misleading details and/or information, of any nature and/or have failed to abide by any of the rules and/or are in breach of the terms hereof and at no point of time will ATL be obliged to notify the Participant, the Entry of whom has been disqualified by ATL.

 

28. If ATL so elects, Participants will be required to submit to a confidential background check to confirm eligibility and help ensure that the Participant will not bring ATL or its entities into public disrepute, contempt, scandal or ridicule or reflect unfavorably on ATL as determined in their sole discretion.
29. All registrations shall be subject to completion of the procedures by the Participant as per instructions given by ATL or the authorized representatives of ATL from time to time. ATL shall not be liable for any failure of receipt or incomplete registrations.

 

30. The Participant agrees that in the event if they refuse to perform any of the acts as required as part of the Contest, such refusal will lead to immediate disqualification of such Participant to be determined at sole discretion of ATL.
31. Submitting the Entry shall be deemed to be consent by each Participant to receive promotional messages and/or e-mails (as the case may be) from ATL and/or sponsor of the Contest or any third party so authorized by ATL.

 

• OTHER TERMS

32. In case of any dispute or difference in respect of this Contest, Terms and Conditions, etc., the decision of ATL’s management shall be final and binding on all concerned. No correspondence disputing this Contest, Terms and Conditions, decision relating to the Winners, any decision of ATL’s management, etc will be entertained by ATL.

 

33. The Participant shall have a right to request ATL to modify personal information to correct any inaccurate or incomplete information that ATL may hold and the right to request ATL to delete or remove its personal information from ATL’s records. However, upon such request to delete/remove been made, the Participant acknowledges that in case ATL will be unable to contact the Participant then the Participant’s participation shall be automatically rejected and the Participant shall have no claim on the Prize whatsoever.

 

34. The Participant hereby acknowledges that he/she has completely read and fully understood the above Terms and Conditions and agree to abide and be bound by it and all information given by the Participant is true and correct and the Participant shall be responsible and liable to indemnify the ATL and/or its associates/representatives/sponsors/assignees/affiliates etc. against any loss/damage/claims etc. arising due to any misrepresentation or incomplete information provided by the Participant.

 

35. All registrations shall be subject to completion of the procedures by the Participant as per instructions given by ATL or the authorized representatives of ATL.

 

36. If the Participant is found indulging in any malpractices such as cheating, misrepresentation, providing false information then the Entry of such Participant shall not be taken into consideration and further any strict legal action may be taken by ATL against such a Participant. ATL further has the right to withdraw the Participant’s participation in the Contest in the event ATL believes or has reasons to believe that the Participant is (i) legally disabled (ii) had or has a criminal record (iii) has been involved in any act of moral turpitude including but not limited to sexual harassment, fraud etc.

 

37. Participants hereby agree and undertake that they shall not accept /give or undertake to accept/give or undertake to give, either directly or indirectly, any gifts, commission or other favor, of any kind whatsoever, to facilitate them winning the Contest. Any knowledge of such an act shall lead to immediate disqualification of such Participants and ATL shall be entitled to take any/all actions against such Participants, as deemed fit by it.

 

38. No waiver of any rights by ATL will be taken as a waiver of any other rights it may have. For instance, if ATL waives its right to object to a particular breach of these terms and conditions by the Participant, it does not prevent ATL from objecting to any other breaches.
39. Participant hereby agrees that in the event they win the Prize, they shall abide by all the rules of the organizers/sponsors/etc. of the said Live Event. The Participant further agrees and acknowledges that the organizers, sponsors and/or any person connected with the management of the Live Event reserves a right to restrict entry to the Participant if the Participant is found in any breach of any of the rules and in such event, the Participant shall not hold ATL liable in any manner whatsoever.
40. The Participants hereby agree and acknowledge that ATL is not the organizer of the Live Event and all decisions pertaining to the Live Event including without limitation, the venue, date, time, etc. shall be at the sole discretion of the organizers of the Live Event and ATL shall have no liability in any change / cancellation of the Live Event.
41. The Participants hereby agree and acknowledges that any arrangement/ sponsorship towards the travel, lodging, boarding, local tour, food, other hospitality facilities and /or documentation with respect to ticketing/travelling including but not limited to visa of the Winner(s) and/or any other person accompanying the Winner(s) shall be their sole responsibility and any costs/expenses towards the same shall not be borne by ATL and/ or any person connected with the management of the Live Event.

 

1. NO LIABILITY
2. By entering this Contest, the Participant agrees to hold harmless and keep indemnified the ATL, their agencies and their employees/affiliates/subsidiaries/group companies, and judges, if any, of the Contest against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) Participant’s participation in the Contest; (ii) the content of the works, (iii) the receipt or use of the Prize awarded; and (iv) the administration of the Contest and the distribution of Prize awarded. Participants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including negligence) including but not limited to loss or damage to person or property which the Participant and his/her representatives or assignees may have, suffer or which may hereinafter accrue to the Participant or as a result of the Participant’s participation in the Contest or use of the prizes awarded. Further, the Participant further agrees to indemnify the ATL, their agencies and their employees/affiliates/subsidiaries/group companies, and judges, if any, against any claims that might arise from his/her works submitted to the ATL while participating in the Contest or due to any representations, misrepresentations or concealment of material facts by the Participant. To the fullest extent permitted by applicable law, the Participant hereby waives all claims against ATL for any indirect, incidental, punitive, remote and consequential losses/ claims/damages.

 

43. By participating in this Contest, the Participant also represent and warrant that the Participant will be solely liable for any and all action (criminal/civil) arising therefrom and shall also be liable to indemnify ATL and/or their agencies/sponsors and all of their employees/affiliates/subsidiaries/group companies, and judges, if any, of the Contest, against any loss, claim, dispute, disrepute, disruption caused to it.

 

44. ATL or and/or their agencies/sponsors and all of their employees/affiliates/subsidiaries/group companies, and judges, if any, of the Contest etc shall not be liable for any loss, injury, mental/psychological issues like anxiety, depression, stress etc. or even death caused to the Participant during his/her participation in the Contest and/or during the Live Event.

 

45. The Participant acknowledges that ATL shall not be liable for any mishap, injury, accident, untoward incident, physical harm of any nature, death, loss of life or limb, etc., caused to them during the Contest and/or Live Event and the same shall not be attributed to ATL or its partners/sponsors/production house etc. and ATL or its partners/sponsors/production house etc shall not be held responsible towards the same nor shall be liable to indemnify or make good any claim being raised against it, for whatsoever nature.

 

46. The Participant hereby undertakes to pay all such necessary Fee, Taxes, duties or levies as may be applicable for the purpose of entry to the Live Event, for any reason, shall be borne and paid by the Participant. In case the Participant fails to pay the requisite fee, taxes, duties or levies, if any, ATL shall have a right to eliminate the Participant and may in its sole discretion hand over the Prize to another winner and the Participant hereby agrees that it shall have no claim / right against ATL and/or its partners/sponsors/production house etc.

 

1. MISCELLANEOUS
2. ATL reserves the absolute right to modify, amend or alter the rules governing the Contest in its sole discretion without giving any prior notice. The updated Terms governing the Contest will be published by the ATL at the same Website where the original Terms and Conditions are published. It shall be the sole responsibility of the Participants to check the Rules and Regulations of the Contest on the Website.

 

48. The interpretation and implementation of the Terms and Conditions shall be at the sole discretion of ATL. The decisions of ATL shall be final and binding, and not subject to challenge or appeal.

 

49. The Participant hereby acknowledges that submitting Entry/Entries and participating in the Contest shall be deemed as acceptance of these Terms and Conditions and it shall be deemed that due notice of the terms contained under these Terms and Conditions had been provided to the Participant.

 

50. Nothing herein shall be deemed to create a partnership, agency or an employer-employee relationship between the Participant and ATL.

 

51. The Terms and Conditions shall be governed, interpreted by and construed in accordance with the laws of England and Wales and the Courts of England and Wales shall have sole and exclusive jurisdiction over any suit or other proceeding arising out of or based upon these Terms and Conditions.

 

52. The Participant agrees and acknowledges that ATL and/or any party authorized by ATL shall be entitled to have access to the Entries at all times during the Contest.

 

53. This electronic record is generated by a computer system and does not require any physical or digital signatures.

 

54. Participants shall be solely responsible for any costs and expenses incurred towards internet connection charges, e-mail transmission charges, data transfer (send/receive) charges, mobile connection charges or other incidental costs or expenses as may be applicable, inclusive or exclusive of any other service charges, applicable taxes, levies, duties, cess, etc. depending upon the service provider.

 

55. All information provided by ATL is provided “As is” without warranty of any kind. To the fullest extent permitted by applicable law, ATL disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement. Without limiting the foregoing, ATL specifically disclaim any warranty (a) that the Contest will be uninterrupted or error-free, (b) that defects will be corrected, (d) regarding the security of information submitted, and (e) regarding correctness, accuracy, or reliability.

 

56. The Participant represents and warrants that there are no alleged, threatening, or pending litigation related to him/her which will impact ATL and/or the Contest in any manner.

 

57. Nothing stated in this Agreement shall be construed so as to require the commission of any act contrary to law and wherever there is any conflict between any provision of this Agreement and any material statute, law, ordinance or regulation contrary to which the Parties have no legal right to contract then the latter shall prevail but in such event the provisions of this Agreement so affected shall be curtailed and limited only to the extent necessary to bring it within the legal requirements.

 

58. If any provision of these Terms and Conditions is deemed invalid by any law or a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and ATL’s failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. ATL reserves the right to amend these Terms and Conditions at any time and without notice, and it is the Participant’s responsibility to review these Terms and Conditions for any changes. The Participant’s use of the Website following any amendment of these Terms and Conditions will signify its assent to and acceptance of its revised Terms and Conditions.

 

59. The ATL does not make any commitment, express or implied, to respond to any feedback, suggestion and, or, queries of the Participant at any stage.

 

60. The Participant represents, warrants and agrees that he/she shall at all times be in full and complete compliance with all applicable laws, statutes, acts, rules, customary norms.

 

61. Any entry submitted by the Participant in connection with the Contest shall be irrevocable and not subject to challenge or appeal.

 

62. ATL reserves the right to terminate and/or postpone the Contest without giving any prior notice to the Participant(s). Such decision shall be final and binding on the Participant(s) and the same shall not be disputed and/ or challenged in a court of law.

 

63. The Entry made by the Participant is non-transferable and non-exchangeable. The Participant agrees that the Prize won by the Participant upon winning the Contest shall not be transferred to any other person and /or redeemed for any kind or cash.

 

64. The Participant or any person related to them shall not attempt to gain unauthorized access to the Participant accounts, servers or networks connected to ATL’s services by any means including but not limited to disrupt ATLs services by uploading content which contains software viruses or any other computer code, files designed to interrupt, destroy or limit the functionality of any computer resource. The Participant or any person related to them agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server used to offer or support ATL or ATL services.

 

65. ATL, all participating sponsors, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies shall not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or Entries (b) electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any disruptions, injuries, losses or damages caused by events beyond the control of ATL.

 

66. ATL is empowered to take a decision on any case not covered by the present Terms and Conditions and the said decisions shall be considered as final and binding on the Participants.

 

67. These Terms and Conditions, together with the any other terms of use, privacy policy on any platform of ATL, constitute the entire agreement between the Participant(s) and ATL in relation to the Contest and supersede all previous agreements in respect of the Participant’s participation. In the event of any inconsistency between any Terms and Conditions or Conditions contained herein and any other terms of use, privacy policy on any platform of ATL, the terms under these Terms and Conditions shall control and govern to the extent of such inconsistency or ambiguity.

 

68. ATL shall not be held accountable/liable for any disruptions/stoppages/ interruptions or cancellation of the Contest and/or the Live Event on account of any event whatsoever including but not limited to any force majeure factors or otherwise.
